Company, agent to pay Dh100,000 compensation to car owner in UAE

The customer had bought a sports car worth Dh335,000.
The Abu Dhabi court has ordered a renowned car company and its agent to pay Dh100,000 as compensation to a customer for a technical fault in his car.
It was due the fault that the car owner could not use his vehicle for a long period of time.
The car manufacturer as well as its local agent have been asked to pay the amount to the car owner for the amount of time that the car was not functional, as rent for the ‘alternative’ vehicle that he used along with the physical as well as the non-physical damages that the car owner endured.
The court also ordered the manufacturer along with the local agent to guarantee the owner of the car an amount of Dh100,000 with a rate of 5 per cent as an annual legal interest from the date of the final judgment, until the entire payout.
Lawyer Ali Al Khaja said that his client had bought a sports car worth Dh335,000 and had also carried out all of the necessary and regular maintenance procedures as per schedule.
The lawyer also conveyed that it was a few months after the purchase, that his client encountered the problem of a “vibrating gearbox”. The customer informed the car company’s agent of the problem who carried out maintenance procedures, thrice on the car. Following that the agent informed the car owner of the inability to solve the issue on grounds of manufacturing defect.
It was after this that the car owner filed a complaint in court.
